Protecting and promoting academic freedom in Southeast Europe: a human rights-based analysis of challenges and solutions

dc.description.abstractAcademic freedom across Southeast Europe (SEE), particularly in Albania, Bosnia and Herzegovina, Kosovo and Serbia, remains systematically constrained by political interference, leadership capture, institutional autonomy limits, corruption/clientelism, financial dependency and research underfunding, politicisation of knowledge and curriculum, and shrinking democratic space for critical thought, undermining universities’ capacity for independent inquiry, quality education, innovation and democratic resilience. This policy brief, based upon the human rights-based approach, analyses these threats through the lens of international human rights law, including binding treaties and the more recent Working Group on Academic Freedom’s nine Principles, to assess gaps between formal legal guarantees and practical implementation. Serbia faces acute political capture, Bosnia and Herzegovina grapples with constitutional fragmentation, Kosovo structural politiciation and Albania persistent executive influence despite reforms, highlighting that all four countries share implementation deficits that weaken higher education quality and regional democracy. The brief argues reform is both urgent and feasible, presenting three models, Nordic ‘onion-model’ layers, Montenegro legislative fortification and Estonian political pluralism, that offer actionable pathways. Key recommendations call for governments to entrench merit-based autonomy and depoliticise accreditation; universities to adopt Academic Freedom Charters and independent ombudspersons; civil society to monitor interference; and regional actors to leverage conditionality. These measures would align SEE higher education with human rights obligations, retain talent and strengthen democratic stability across the region.
