Abstract

In the digital age, an overflow of content is shared and uploaded on a daily basis on the internet. This large volume often exceeds human capacity to manually analyze before it is posted. As a result, many online platforms now rely on automated processes to efficiently detect and moderate illegal or problematic content such as disinformation, hate speech, and terrorist propaganda. Furthermore, mobile instant messaging apps like WhatsApp, Telegram, and Signal have become increasingly important due to their widespread use among smartphone users. These messaging apps now play a crucial role in everyday communication, political discussions, and coordination of collective endeavors. Consequently, the author finds it beneficial to explore this particular area. The aim of this thesis is to analyze the legal implications of automated content moderation and the future trends within the context of European Law and the protection of freedom of expression. The research will investigate the challenges and complexities of automated content moderation in light of pertinent European regulations, including the General Data Protection Regulation (GDPR), the Digital Services Act (DSA)e, and the European Convention on Human Rights (ECHR), especially Article 10, which guarantees freedom of expression. The thesis aims to explore the scope of content that can be moderated, the role of algorithms and AI in content moderation decisions, the impact on freedom of expression, the right to privacy, and other fundamental rights. The subject of the research 'The AI Dilemma: Can Automated Content Moderation in Mobile Instant Messaging Applications Safeguard Freedom of Expression?' is highly significant due to its interdisciplinary nature, combining elements from IT and Law. Drawing upon both English and Greek literature, this investigation aims to offer an extensive understanding surrounding these complex issues by taking into account legal frameworks, technological advancements, and their impact on individuals' rights and online communication. The utilized strategy involves the application of an analytical and interdisciplinary methodology for conducting legal research.
