Entretejiendo el Capítulo Étnico del Acuerdo Final de Paz: Desafíos para la Implementación del Sistema Integral de Verdad, Justicia, Reparación y No Repetición (SIVJRNR) en las Víctimas de los Pueblos Indígenas de Colombia 2016-2021

Abstract

The Final Peace Agreement managed to incorporate an Ethnic Chapter; for its compliance, an institution was created in charge of seeking truth, justice, reparation and guarantees of non-repetition for the victims in the country, including indigenous victims. This thesis focuses on reviewing compliance with the implementation of the Ethnic Chapter in five years of the post-Agreement and its challenges, mainly in reference to point five with the Comprehensive Peace System that groups the Unit for the Search for Persons Given as Disappeared (UBPD), the Commission for the Clarification of Truth, Coexistence and Nonrepetition (CEV) and the Special Jurisdiction for Peace (JEP). These three entities have been carrying out actions even in the midst of the armed conflict that is still in force and in the midst of the COVID-19 pandemic; Even so, it is not enough and progress is minimal compared to what the indigenous victims expect; According to the investigation, it can be seen that the UBPD has not advanced, the JEP is in an intermediate process and the CEV has advanced. The victims of the Indigenous Peoples have reiterated that there is a physical and cultural extermination that has become genocide against the lives and indigenous territories, where they continue to resist for their survival with or without an ethnic Chapter. _____________________________________________________________

El Acuerdo Final de Paz logro incorporar un Capítulo Étnico; para su cumplimiento, se creó una institucionalidad encargada de buscar verdad, justicia, reparación y garantías de no repetición para las víctimas en Colombia, entre ellas, las víctimas indígenas. Esta tesis se centra en la revisión del cumplimiento de implementación del Capítulo Étnico a cinco años del Acuerdo y sus desafíos, principalmente en lo referido al punto cinco y al Sistema Integral de Paz que agrupa a la Unidad de Búsqueda de Personas dadas por Desaparecidas (UBPD), la Comisión para el Esclarecimiento de la Verdad, la Convivencia y la No Repetición (CEV) y la Jurisdicción Especial para la Paz (JEP). Estas tres entidades han venido adelantando acciones aún en medio del conflicto armado que sigue vigente y en medio de la pandemia de COVID-19, aun así, no es suficiente y los avances son mínimos en comparación con los que las víctimas indígenas esperan. De acuerdo con la investigación, se puede evidenciar que la UBPD no ha avanzado, la JEP va en un proceso intermedio y la CEV ha progresado. Las víctimas de los pueblos indígenas han reiterado que hay un exterminio físico y cultural, que se ha convertido en un genocidio en contra de las vidas y los territorios indígenas, en donde siguen resistiendo para su pervivencia, con Capítulo Étnico o sin él.
